The following terms and conditions apply to all agreements that the customer (hereinafter "you") meets with modstrom.com. By using this website and / or placing an order with us, you agree to the terms and conditions that apply to us. Make sure you have read and understood the terms and conditions that apply to us before you place your order. We reserve the right to change these terms from time to time without prior notice to you. The version of the terms and conditions that apply to your order will be those that can be found on the website at the time you place your order.
These terms and conditions apply to the purchase of goods on www.modstrom.com and for delivery in Denmark, excluding Greenland and the Faroe Islands, unless otherwise exlicitly agreed.

Ordering and payment
www.modstrom.com is open 24 hours a day, so you can almost always shop online with us. However, it may happen that we close the shop for maintenance. You can only realize purchases when the store is open and available. To shop on www.modstrom.com you must be 18 years of age and possess a valid credit card that we accept. If you are not yet 18 years of age, however, you can still purchase items if you have obtained your guardian's consent or otherwise have a legal right to enter into the purchase.

You select the items you want to buy and put them in the "shopping basket". You can continuously edit the content of your shopping cart before you make your purchase, and you can frequently check the content and price of the goods. Any additional payments such as shipping costs will not be calculated immediately, but before you are proceeding to check out. When you are ready to order, click on the cart. Enter your name, address, email, phone number, payment method and choose the delivery form. You can change the content of the shopping cart until you confirm your purchase by pressing "CONFIRM ORDER AND PAY". After this, your order will be send to www.modstrom.com.

Shipping - Denmark
Shipping with GLS parcel shops and for business addresses in Denmark costs 35 dkk. The price is the same regardless of size and weight.
For a purchase of minimum 500 dkk, we offer free shipping with GLS Parcel Shop / GLS Business. On weekdays we strive to send your goods within 24 hours after you have placed your order. If you place your order before 12 p.m. on weekdays, we aim to have the product shipped the same day. Delivery to residential and business addresses in Denmark is within 1-3 days.

Shipping – International orders
We strive to ship your package within 24 hours after you have placed your order. If you place your order before 12 p.m. on weekdays, we will try to have the product shipped the same day. Shipping is via GLS International and the expected delivery time is 4-10 working days. Shipping costs for international orders is 75 dkk - (est. 10 euro). The price is the same regardless of size and weight.
We deliver to the following countries: Austria, Belgium, Finland, France, Germany, Ireland, Italy, Luxembourg, The Netherlands, Portugal, Spain, and Sweden.

Secure payment
It is safe to shop with credit cards and paypal at www.modstrom.com. The credit card information is transmitted in encrypted form using SSL (Secure Sockets Layer). Encryption technology has a high safety standard. This means that the information is sent via a secure connection and that your card details cannot be read by outsiders. Only NETS can read your data. In addition, we use ePay payment gateway, certified by the PCI standard.
You can pay with following credit cards: VISA, VISA/Dankort, VISA Electron, Eurocard, Maestro, MasterCard and MasterCard Debit. We also offer payment via PayPal.
We debit the money as soon as the goods are shipped. We hold any card fees associated with your purchase.

Acknowledgement of receipt of order and order confirmation
When you order an item, you will receive an onsite confirmation of our receipt for your order. You first enter a binding purchase agreement once you have received an order confirmation email from us.

30 days return policy (Including withdrawal deadline and "used goods")
When you buy from www.modstrom.com you have a 30 days return policy. Within this period you can inform us that you want to withdraw from the contract entered and then return the product to us. This extended return policy applies only to products that have not been put into normal use. There is a 14 days return policy on items that you have used. If the item has been used it can still be returned. As a consumer you have the right to take the goods into "eyesight", which is the same right that applies to a purchase realized in a physical store. You may after receipt only use the goods in a way so that you can maintain the shape, characteristics and the way they function. If the product is used, you can get back the price paid only partly or not at all. It is the consumer who has to pay for a potential depreciation of the item. We preserve the right to value the item according to what we can get for it in a resale.
Rights are valid from the day you received the goods. If the deadline expires on a holiday, a Saturday, Constitution Day, Christmas Eve or New Year's Eve, it is extended to the following business day. As for orders that include several goods, that are delivered individually or goods delivered in more than one batch, time is counted from the day you received the last unit or batch.
To exercise this right, you must give us notice within 90 days after you received your items. This means that you as a consumer cannot cancel your purchase by inaction. If you wish to cancel your purchase, you can send an email to support@modstrom.com.

Returns
If you regret your purchase, the goods must be returned to:

We expect the goods to be securely wrapped. You have the responsibility for the parcel/goods until we receive it, so keep the postal receipt as well as the tracking number. You are to pay the costs of returning the goods if you change your mind.

IMPORTANT
We expect you to send the goods as soon as possible after you have given notice of cancellation and you must return them within 30 days from the day you receive the parcel.
Note: We do not accept packages sent COD.

Documentation of your purchase and return form
You must attach a copy of the order confirmation, invoice or other proof of your purchase. Additionally, it will facilitate the processing if you attach a completed return as we enclose in all our shipments. If you have lost it, download a new one right here.

Refund
Once we receive the item, we will review it and you will receive the amount you have paid to us when you purchased the item. If our conditions regarding returns and "used goods" have been kept. We will initiate a refund within 30 days after the notice of cancellation was received. We reserve the right to pause the payment until the goods are received or transmitted proof that the item is returned.
The amount is always transferred to the same means of payment that you paid with.
NOTE:
You may lose the right to receive back your money, in whole or in part. This happens if the product is impaired because: - You have actually taken the product into use,- It has been damaged while you were responsible for it,- You have used the items in another way than it was required in order to maintain the shape, characteristics and the way they function.- You did not follow the requirements of our return policy regarding sealing, product type etc.

Complaints
Your purchases are covered by the Sale of Goods Act (Købsloven). This means that the consumer has 24 months of warranty, so you can either have a faulty product repaired or replaced, get a refund or reduction in price, depending on the specific situation.
Of course it is a requirement that the complaint is justified and that the defect is not caused by incorrect use of the product or other inappropriate treatment. You must complain within "reasonable time" after you have discovered the defect. We recommend that you contact us as soon as possible, and within 2 months after the error was discovered.

When you return the item, please add as much details as possible, specifying the nature of the problem. Feel free to use our return form. It is not a requirement to do so, but it facilitates the process of assessment and minimizes the processing time of your complaint. Note: We enclose a return note in all our shipments.

In case of a justified complaint we will refund reasonable transportation costs.
In case of a justified and thus successful complaint we will refund reasonable transportation costs. Otherwise, you will bear all costs of transportation including our delivery costs of 35 dkk - for returning the item. Further, we may charge you an amount of up to 35 dkk - for examination of the goods. We only want happy customers and can only encourage you to contact us if there are any problems with the products you have purchased.
Remember that the product must always be in proper packaging and contain the receipt for shipment. You have the responsibility for the parcel/ goods until we receive it. Therefore, keep the postal receipt incl. information about shipping costs and your track and trace number.

The above data is stored with information on the items you bought. This data is stored for 5 years from the end of the financial year to which the information relates in accordance with accounting Act § 10. After that, the data will be deleted. In case you have created a login for the use of self-service, your personal and order information will not be deleted unless you ask us to do so.
Information will not be shared with or sold to third parties, except from the case of restructuring, or the full or partial sale of the company. Any disclosure in such situation would be in accordance with the then-current privacy legislation.
As a customer you have the opportunity to gain insight into the recording of data about you, and you may object to the registration pursuant to the respective rules in the law concerning the processing of personal data. Comments should be presented to Modström by mail support@modstrom.com.

Purchases of goods on www.modstrom.com is subject to Danish law. Any dispute settled by the Danish courts.

Complaints and appeals boards
If you have a complaint concerning your purchase, please send an email to support@modstrom.com or call (+45) 96 32 42 95. If we cannot find a solution, you may want to send a complaint to the "Konkurrence- og Forbrugerstyrelsen" (Competition and Consumer Authority) if the conditions are met.

Reservations at fault
We reserve the right of inventory errors, typographical errors and pricing errors. In case of failure, we reserve the right to cancel the order after we have made the buyer aware of this.

Confidentiality
Modström takes responsibility for all the personal information you provide us with. We use this information to assess the agreement, for deliveries, to take care of the customer relationship arising therefrom, for pursuing outstanding payments, fraud prevention and abuse and to comply with legal requirements.
Modström does not submit any information to third parties. The information is available only for the company of Modström. In case you wish to gain insight into the personal information we keep on you, please contact support@modstrom.com.

Warranty
If the goods you have purchased are defective, Modström will comply with all legal guarantees and rules. If you have a complaint concerning manufacturing defects in the goods supplied by us, including damage occurred during shipping, please contact us as soon as possible and return the item to us.

Complaints and Consumer protection
If you recieve a defective item, Modström will account for the shipping costs arising from returning the item or transportation costs. Sale of Goods Act / Act on Consumer Contracts / Law on Consumer Protection, which looks after your interests as a consumer and customer, comes naturally into force when you shop at Modström.

Liability
Modström is not responsible for any damage that might occur to you, except in cases where there's a liability for the company's and in case can be assumed that the insurer approves the disbursement. In addition to these cases, responsibility through limited to the maximum amount that represents the purchase price of the / current item / items. Modström is not responsible for consequential damages.

Force majeure
As a result of force majeure Modström ceases obligations. If the period during force majeure is longer than 2 months, and you as Modström right to terminate the agreement without that in such cases there is no debt to pay for the assailant. The force majeure is meant, among other strikes, illness of personnel, transportation disruptions and import-/eksportforbud whether this occurs in the company or its suppliers.

Colours
We cannot guarantee that the colors displayed on the web shop will be the exact colors of the actual garments. The color reproduction depends on the settings on your computer.
